ನ್ಯಾಯ ತೀರ್ಮಾನದ ಕತೆ
ಒಂದು ಕ್ರಿಶ್ಚಿಯನ್ ಕುಟುಂಬದ ಒಬ್ಬ ಹುಡುಗ ಬೊಂಬಾಯಿಗೆ ಹೋದವ ಹಿಂದಿರುಗಿ ಬರಲಿಲ್ಲ. ಸುಮಾರು ಹತ್ತು ವರುಷ ಆದಾಗ ಅವನಿಗೆ ಮದುವೆಯಾಗಿದೆ ಎಂದು ಸುದ್ದಿ ತಿಳಿಯಿತು. ಇದನ್ನು ಕೇಳಿದ ತಂದೆ ತಾಯಿಯರು ಕೋರ್ದಬ್ಬು ದೈವಕ್ಕೆ ದೂರು ನೀಡುತ್ತಾರೆ. ಅವನನ್ನು ಬರುವಂತೆ ಮಾಡಿದರೆ ನನಗೇನು ಕಾಣಿಕೆ ಕೊಡುವಿರಿ ಎಂದಾಗ ನಿನ್ನ ಭಂಡಾರಕ್ಕೆ ಇಪ್ಪತೈದು ರುಪಾಯಿ ಕಾಣಿಕೆ ಹಾಕುತ್ತೇವೆ ಎನ್ನುತ್ತಾರೆ. ಆಗ ದೈವದ ಮದಿಪು ಹೀಗಿದೆ; ಯಾನೆ ಮಲ್ಲ ಪರ್ವತ ಜರಿಪೊಡು, ಆಂಡ ಎಂಕ್ ತಿಕುನು ಬಜೀ ಕಿಚ್ಚೆಲಿ. ಉಂದು ಎಲ್ಯ ಬೇಲೆ ಅತ್ತ್. ಕರಿಯಣಿ ಕಡ್ತ್‍ದ್ ಕನವೊಡಾಪುಂಡು. ಮಲ್ಲ ಪಾಪೊತ್ತುನು ಯಾನ್ ತುಂಬೊನೊಡು.(ನಾನೇ ದೊಡ್ಡ ಪರ್ವತ ಬೀಳಿಸಬೇಕು, ಆದರೆ ನನಗೆ ಚಿಕ್ಕ ತುಂಡು, ಚಿಕ್ಕ ಕೆಲಸ ಅಲ್ಲ, ದೊಡ್ಡ ಪಾಪ ನಾನು ಹೊತ್ತುಕೊಳ್ಳಬೇಕು).

*ದೈವಕ್ಕೆ ತಂಬಿಲ ಕೊಡುವ ಸಂದರ್ಭ – ಕೋಳಿ ಕೊಂದು ಎಡೆ ಬಡಿಸುವುದು. ಆ ಸಂದರ್ಭದಲ್ಲಿ ಕೊಂದ ಕೋಳಿ ಸರಿಯಾಗಿ ಬೀಳುವಂತೆ ಬಯಸುವುದು. ಅದು ಸರಿಯಾಗಿ ಬೀಳಲಿಲ್ಲವೆಂದರೆ ಕುಟುಂಬಕ್ಕೆ ತೊಂದರೆಯಿದೆ, ಕೋಲ ಕೊಡಬೇಕು ಎಂದು ತಿಳಿದುಕೊಳ್ಳುವುದು.
*ಮನೆ ಒಕ್ಕಲು, ತೊಟ್ಟಿಲು ಕೊಂಡುಹೋಗುವುದು, ಯಾವುದೇ ಶುಭಮುಹೂರ್ತದಲ್ಲಿ ತೆಂಗಿನಕಾಯಿ ಒಡೆಯುವುದು. ತೆಂಗಿನಕಾಯಿ ಸರಿಯಾಗಿ ಒಡೆದು ಬಿದ್ದರೆ ಶುಭ. ಇಲ್ಲವಾದರೆ ಅಪಶಕುನ.
*ದೈವ ವೀಳ್ಯದೆಲೆಯನ್ನು ಹಾರಿಸಿ ಅಂಗಾತ ಬಿದ್ದರೆ ಸರಿ, ಎಲೆಯ ಬೆನ್ನು ಬಿದ್ದರೆ ದೋಷವೆಂದು ಪರಿಗಣಿಸುವುದು.
*ದೈವ ತೆಂಗಿನ ಕಾಯನ್ನು ಹಾರಿಸಿ ಸರಿ ಬೀಳುವುದು.
*ಯಾವುದೇ ದೈವ ಕ್ರಿಯೆಯಲ್ಲಿ ದೀಪ ಉರಿಸಿಡುವುದು.

*ಅದು ನಂದಾ ದೀಪದಂತೆ ಉರಿಯಬೇಕೆಂದು ಬಯಸುವುದು.
*ಹಲವಾರು ಸನ್ನಿವೇಶಗಳಲ್ಲಿ ಸತ್ಯ ಪ್ರಮಾಣ ಪರೀಕ್ಷೆ ನಡೆಯುತ್ತದೆ. ಬೆಂಕಿಗೆ ಕೈ ಇಡುವುದು, ಕಾದ ಎಣ್ಣೆಗೆ ಕೈ ಹಾಕುವುದು ಇಂತಹ ಸಂದರ್ಭಗಳು ನಡೆಯುತ್ತಿದ್ದವು.

*ಆಣೆ ಪ್ರಮಾಣ ಮಾಡಿಕೊಂಡವರು ಮತ್ತೆ ಜೊತೆ ಸೇರಬಾರದು. ಪರಸ್ಪರ ಅನ್ನ ನೀರು ಮುಟ್ಟಬಾರದು,

*ಮದುವೆಯಾಗಬಾರದೆಂಬ ನಿಷೇಧವಿದೆ. ಉದಾ: ಬಳಜೇಯಿ ಮಾಣಿಗನ ಸಂಧಿಯಲ್ಲಿ ಬರುವ ಸನ್ನವೇಶ – ಚೆನ್ನೆಯಾಟದಲ್ಲಿ ಆಟ ಕೆಡಿಸಿದುದಕ್ಕಾಗಿ ಕೋಪಿಸಿ ಮಡದಿ ತವರಿಗೆ ಹೋದಳು. ಮಡದಿ ಮರಳಿ ಬಂದರೆ ಅವಳ ಮೈ ಮುಟ್ಟುವುದಕ್ಕೆ ಮೊದಲು ದೈವಕ್ಕೆ ನೇಮ ಕೊಡುವುದಾಗಿ ಗಂಡ ಹರಕೆ ಹೇಳಿದ. ದೈವದ ಪ್ರೇರಣೆಯಿಂದ ಆಕೆ ಮರಳಿ ಬರುತ್ತಾಳೆ. ಮಡದಿ ಮರಳಿ ಬಂದ ಸಂಭ್ರಮದಲ್ಲಿ ಹರಕೆಯನ್ನು ಮರೆತು, ಮೈಮರೆತು ಆಕೆಯನ್ನು ಬರಸೆಳೆದುದರಿಂದ ಆತ ಹೆಂಡತಿಯನ್ನು ಕಳೆದುಕೊಂಡ ಎಂಬ ಉಲ್ಲೇಖವಿದೆ. ನ್ಯಾಯ ತೀರ್ಮಾನ ಮತ್ತು ಸತ್ಯ ಪರೀಕ್ಷೆಯ ಜೊತೆಜೊತೆಗೆ ದಾನ-ಧರ್ಮ ನೀಡುವ ಸಂದರ್ಭಗಳು ಬರುತ್ತವೆ. ತುಳುನಾಡಿನಲ್ಲಿ ನಡೆವ ಅನೇಕ ಉತ್ಸವ ಸಮಾರಂಭಗಳಲ್ಲಿ ಅನ್ನದಾನ ಧರ್ಮಕಾರ್ಯ ಇಂದಿಗೂ ನಡೆಯುತ್ತಿದೆ. ಅನ್ನದಾನದಿಂದ ಧರ್ಮ ಚೆನ್ನಾಗಿ ನಡೆಯಿತೇ ಎಂಬ ಮಾತೊಂದಿದೆ. ತುಳುನಾಡಿನ ಪ್ರತಿಯೊಂದು ವಾರ್ಷಿಕಾವರ್ತನ ಆಚರಣೆ ಆರಾಧನೆಗಳಲ್ಲಿ ಮತ್ತು ಹುಟ್ಟಿನಿಂದ ಸಾವಿನವರೆಗೆ ಬರುವ ಎಲ್ಲಾ ಜೀವನಾವರ್ತನ ಆಚರಣೆಗಳಲ್ಲಿ ಅನ್ನದಾನ ಪ್ರಧಾನವಾಗಿದೆ.

ದೈವಾರಾಧನೆಯಲ್ಲಿ ಈ ನಾಲ್ಕು ಪರಿಕಲ್ಪನೆಗಳು ಬಹಳ ಪ್ರಮುಖ ಪಾತ್ರ ವಹಿಸುತ್ತವೆ. ಅವುಗಳನ್ನು ಈ ರೀತಿ ಚರ್ಚಿಸಬಹುದು.

ಜನಪದ ನ್ಯಾಯಾಂಗ ಎನ್ನುವುದು ಒಂದು ಸಾಮಾಜಿಕ ನ್ಯಾಯ ಪದ್ಧತಿಯೂ ಹೌದು. ಧಾರ್ಮಿಕ ನ್ಯಾಯ ಪದ್ಧತಿನೂ ಹೌದು. ನ್ಯಾಯಾಂಗ ಪದ್ಧತಿಯನ್ನು ನಿರ್ವಹಿಸುವ ಸಾಮಥ್ರ್ಯ ಭೂತದ ಹಲವಾರು ನುಡಿಕಟ್ಟುಗಳಲ್ಲಿದೆ. “ಪತ್ತ್ ಕೂಡಿ ಕಳಟ್ಟ್ ಮುತ್ತು ಉಂಡು ಪನ್ಪೆರ್. ನಿನ್ನ ಸತ್ಯೊದ ಕಳಟ್ಟ್ ಇಂಚಿನಾಯೆ ಇಂಚ ಮಲ್ತೆ. ಈ ದಾದ ಶಿಕ್ಷೆ ಕೊರ್‍ಯ”. ಹತ್ತು ಜನ ಸೇರಿದಲ್ಲಿ ಕಳೆ ಇದೆ ಎನ್ನುತ್ತಾರೆ. ನಿನ್ನ ಸತ್ಯದ ಕಳದಲ್ಲಿ ಇಂತಹ ತಪ್ಪನ್ನು ಇಂತವ ಮಾಡಿದ್ದಾನೆ. ನೀನು ಏನು ಶಿಕ್ಷೆ ನೀಡಿದೆ ಇದು ನ್ಯಾಯ ತೀರ್ಮಾನದಲ್ಲಿ ನಡೆಸುವವರಿಂದ ಬರುವ ಮಾತು. ನ್ಯಾಯ ಸಿಗಬೇಕಾಗಿರುವುದು ಭೂತ ಕಟ್ಟಿರುವ ಮಾಯ ಸ್ವರೂಪಿ ಸತ್ಯದಿಂದ. ದೈವವು ‘ಬಾಸೆ ತತ್ತಿನಾಯಗ್ ಬಾಸೆ’ ದೀಪೆ ಎನ್ನುತ್ತದೆ. ಎಂದರೆ ನನ್ನ ಮಾತು ತಪ್ಪಿದವನಿಗೆ ನನ್ನಾಣೆ ಎಂಬ ಶಾಪ. “ಪತ್ತಿ ಪಗರಿನ್ ಬೂಮಿಗ್ ಬುಡೊಡಾ ಬಾನೊಗು ಬುಡೊಡಾ?” ಆಕಾಶಕ್ಕೆ ಬಾಣ ಬಿಡುವುದರಿಂದ ಪ್ರಯೋಜನವಿಲ್ಲವೆಂದು ದೈವ ತನ್ನ ಸುರಿಯೆಯನ್ನು ಅಥವಾ ಬಾಣವನ್ನು ನೆಲಕ್ಕೆ ಊರುತ್ತದೆ. “ಪಂಡಿ ನಾಲಾಯಿ ದೊಂಡೆಡಾವೊಡಾಂಡ ನೆತ್ತ ದೃಷ್ಟಾಂತ ತೋಜಾವೆ” ಎಂದು ಶಾಪ ನೀಡುತ್ತದೆ. ಇಂದಿಗೂ ಸರ್ಪವನ್ನು ಕೊಲ್ಲುವವರು ಅದು ನೆಲ ಕಚ್ಚದಂತೆ ಕೊಲ್ಲುತ್ತಾರಂತೆ. ‘ಮಣ್ಣ್ ಮೂರಿ ಲಕ್ಕ್‌ದ್‍ಂಡ್’, ‘ನೆಲನೇ ತುಚ್ಚು’ ಇಂತಹ ಮಾತುಗಳಲ್ಲಿ ದೈವವನ್ನು ನಡೆಸಿಕೊಡುವವರು ಮತ್ತು ಕಟ್ಟುವವರ ಮಾತಿನಲ್ಲಿ ಭಯ ಹುಟ್ಟಿಸುವ ಮಾತುಗಳು ಬರುತ್ತವೆ.

ಜನಪದ ನ್ಯಾಯಾಂಗ ಎನ್ನುವುದು ಒಂದು ಫ್ಯೂಡಲ್ ಪದ್ಧತಿಯೂ ಹೌದು. ಆಳುವವರು, ಶ್ರೀಮಂತರು, ಊರ ಯಜಮಾನಿಕೆ ಇರುವವರು, ಮೇಲ್ಜಾತಿಯಲ್ಲಿರುವವರು ತಮ್ಮನ್ನು ಉಳಿಸಿಕೊಳ್ಳುವ ಪ್ರಯತ್ನ ಮಾಡುತ್ತಾರೆ. ಪರತಿ ಮಂಗಣೆ ಎಂಬ ಆರಾಧನೆಯಲ್ಲಿ ಪರತಿ ಭೂತಕ್ಕೆ ಕಟ್ಟುವ ಪರವನ ಹೆಂಡತಿ. ಆಕೆಯ ರೂಪಕ್ಕೆ ಮರುಳಾಗಿ ಪರವನನ್ನು ಉಪಾಯವಾಗಿ ಕೊಂದು ಆಕೆಯನ್ನು ವಶಪಡಿಸಲು ಸಾಧ್ಯವಾಗದೆ ತನ್ನ ಸರ್ವಸ್ವವನ್ನೂ ಪರವನ ಚಿತೆಗೆ ಸುರಿದು ಕೊನೆಗೆ ಆತನೂ ಚಿತೆಗೆ ಹಾರಿಕೊಳ್ಳುವಂತ ದುರ್ದೈವಿಯೊಬ್ಬನ ಕೃತ್ಯದ ವಿವರ ಬೊಟ್ಟುವಾದಿ ಬಲ್ಲಾಳನ ಸಂಧಿಯಲ್ಲಿ ಬರುತ್ತದೆ.

ಆಳುವವನಿಗೆ ಊರ ಸಂಪತ್ತು, ಹೆಣ್ಣು, ಯಜಮಾನಿಕೆ ಎಲ್ಲವೂ ಬೇಕಿದ್ದ ಕಾಲವಿತ್ತು ಎಂಬುದು ಜನಪದ ಸಾಹಿತ್ಯದಲ್ಲಿ ತಿಳಿದುಬರುತ್ತದೆ. ಆ ಕಾಲದಲ್ಲಿ ಭೂತವಾಗುತ್ತಿದ್ದರು. ಈಗ ಅಂತಹದಕ್ಕೆ ಜನ ರಾಕ್ಷಸರಾಗುತ್ತಾರೆ.

ಉಳುವವನೇ ಹೊಲದೊಡೆಯ ಎಂಬ ಕಾನೂನು ಬಂದಾಗ ದನಿ ಒಕ್ಕಲು ಕಾನೂನು ಬಂದ ಸಂದರ್ಭದಲ್ಲಿ ಭೂ ಮಾಲೀಕ ಒಕ್ಕಲಿನಿಗೆ ಭೂಮಿ ಬಿಟ್ಟುಕೊಡುವ ಪ್ರಸಂಗವೂ ಬಂತು. ದೈವ ಯಾರ ಕಡೆ ನ್ಯಾಯ ಒದಗಿಸಿರಬಹುದೆಂಬುದನ್ನು ನಮಗೆ ಕಲ್ಪಿಸಿಕೊಳ್ಳುವುದಕ್ಕೆ ಅಸಾಧ್ಯ. ದೈವವನ್ನು ನಡೆಸುವವ ಮತ್ತು ಕಟ್ಟುವವ ಇಬ್ಬರೂ ಜೊತೆ ಸೇರಿ ಊರಿನ ಗ್ರಹಸ್ಥರ ಮಾತು ಮೊದಲು ದೈವದ ನಡೆ ನಂತರ ಎಂದು ತೀರ್ಮಾನಿಸಿದರು. ಎಷ್ಟೋ ಒಕ್ಕಲುಗಳ ಮನೆಗೆ ರಾತ್ರೋ ರಾತ್ರಿ ಬೆಂಕಿ ಬಿತ್ತು. ಅವರು ಊರು ಬಿಟ್ಟು ಓಡಿದರು. ದೈವದ ವಿರುದ್ಧ ಮತ್ತು ಊರಿನ ಯಜಮಾನರ ವಿರುದ್ಧ ಮಾತನಾಡುವುದು ಕಷ್ಟವಾಗಿತ್ತು.
